HELP! Insurance company trying to low ball estimate?

Back in April I was driving and a lady tried switching lanes and struck my vehicle. I immediately went to an auto body shop and got an estimate for the damage, they took photos and everything. I've been contacting her insurance and dealing with this for over two months... I had to send them the police report because the woman tried lying and said I hit her, so I had to prove she was at fault. They would never return my calls. Until I talked to the field adjuster. He then called me yesterday told me he got the estimate from the body shop which was one of their recommended shops, and was mailing me the check for the damage. However he failed to tell me the check he was sending was for $1000 less than the estimate. I don't agree with this, what do I do? I called and no one will call me back from the company Also, I own my car outright. It's a 2004 tiburon is excellent condition. The insurance company was giving me issues about me wanting the check sent to me. I plan on getting the damages repaired that are necessary but leaving what isn't and keeping the money that's left over. I'm not even making them get me a rental for the time I don't have the car! I recently had my car damaged in one of our Texas storms. It caused about $4000 in damage to the entire left side, hood, and both bumpers, and knocked out two windows. I just got my car back from the insurance suggested body shop and I can still see where many of the rock marks were painted over. There are divets in the paint in a lot of spots, which is better than the metal that was showing before, but not how I want it. My question is, shouldn't they have completely sanded down the areas of the car that needed to be repainted instead of just painting over the paint nicks? The car is a 2006 Mustang that is practically brand new. Maybe I am wrong, but shouldn't the insurance company be fixing the car to the PERFECT condition it was in before it was damaged?

My problem is this, In July 2007 A man in a huge truck with a trailer hinge back up out from a parking space, it I saw him and the only thing I could at the time is speed up so he would not hit the middle of my car. He ended up hitting the side bumper and ripped it off. I have A 1999 Cryshler Sebring. It truely was a hard hit. Well the man's insurance did pay to fix the bumper, but now everything keeps going wrong. I did mention it to the person at the shop where we had arranged for the repair. When the time came, She did not do so and when I asked the lady she gave me a look like there is really something wrong with my car. I give two guys a ride to the bus so they do not have to walk the mile or so and they can attest that my car was running smooth. So many things one after another have gone wrong. I have put over 700.00 and still more problems. So my question is what do you think my chances are If I take it to the manufactor and they will rule in my favor. The Insurance Co-ordinator says if they say it was from the accident then they will pay for it. Straight from the start right after the accident my car kept dyeing out, so I had to drive it like a standard car with my feet on the gas and brake at the same time. So in the end , last I have heard there is a short somewhere so I took it to Spitfire and place that specializes in electrical problems and he told me my computer is bad. First of all the things my battery kept dyeing out, my car would not start up in the mornings,I took it to Auto zone and my battery was fat, swollen no good. Bought a new one, then I took it to a man at midas , he said I needed a valve cover gasket and he showed me my spark plugs we filled with oil, fixed that. Now Midas ran a scan and said I had either a bad map sensor or a short. Changed the map sensor the car is still barely running, so then another place said it was a short but had it for two weeks and could not find the short . I would like to know , if the guys Insurance is still on the hook for all the problems I have had with the car since the accident. Hey, I dropped my motorcycle on the right side yesterday during a turn. It's a 2009 Kawasaki Ninja 250r. Two pieces of fairing were damaged pretty badly (right side and front piece). I just got insurance the day of the drop (before dropping it). Will insurance cover the damage? Also is it even worth getting them involved? Hello Yahoo Community, I am married, pregnant, with no health insurance. I have applied for Medicaid and CHIP and was denied assistance based on my income, I apparently make too much money to qualify. I slightly cross the threshold. If you subtract our bills minus our earnings we're left with peanuts. We only pay for necessities not for commodities. There is nothing I can cut back on because we're paying for the basic stuff. I'm 18 years old and passed my driving test on the 30th September 2010. I don't have a car because I cant afford the insurance. I'm working full time. I found a nice little car, a 2001 RENAULT CLIO, 1.2 16V 3dr Hatchback. I used a price comparison site to get a basic idea of what the insurance would be on it - and using my real own details and it was 5993. So I messed around a bit and added my mum as a second/extra driver. The price crashed down to 3,153. The option to add another driver was still there so I added my dad too and the price is now 2,617 - much more in my price range. I called them in and was like look at this and what do you think and they both agreed that there was something wrong with it and there would be a catch somewhere but I disagree. It irritates me beyond words that people these days are almost forced to have a poor diet because junk food is more affordable. Rain now gets in through the top as the seal is broken as well. She is insured and believes she has coverage but she's scared cause she left the scene. This was 3 weeks ago - there has been no follow up. She hasn't called the police but kept an eye out for whether or not it was reported and she needed to come forward. It was in a pretty run down part of town. Anyway - I don't know what to tell her so i'm coming here - can she report this to insurance and admit that she swiped a bus and didn't stop? Will they fix it, up her insurance, and move on or will they investigate into the bus - making her pay for the bus and having the legal issue of leaving the scene. - not sure what to tell her??? She's also considering just putting a new skin/shell on the door was affected - not seeing if this is possible though - replacing the entire door is expensive and seems unnecessary. California Speeding ticket and no proof of insurance?

It was dark and raining. I just came off the bay bridge in SF and am positive I was driving below 40 on the bridge and between 40-60 when I got off the bridge. The cop was on 80E past fremont exit. He said I was at 67 in a 50 zone and also did not give me enough time to look for my proof of insurance. He said lets make this easy and quick and cited me for speeding and the no proof of insurance as non-correctable. It this accurate? I don't think his radar reading is accurate. Hi, I have received a letter from my insurance company stating that i have had an insurance claim against me, and i asked them for more detail, the time and date. I bought a 1999 Honda for $4,500 in March of 2010 from a private party, about nine months ago. The owner never disclosed the fact that the car had been totaled in December on 2009. Somehow the insurance discovered that it had been perversely totaled, which I was not aware of. I had full coverage on the car. They now are saying that I will get receive what the car is worth with a savaged title. My question is, do I have to except this or can I fight for the value of a clean titled vehicle? Should they have run a check on the vin when I insured it with them and discovered the that the vehicle had been totaled before? Or is everything my fault?

Today I was involved in a horrible collision. Car made a complete stop put hazard lights on, I made a complete stop at a reasonable distance however 15 seconds after I stopped I look at the mirror and a taxi van cab slams right into me my car goes flying forward hits the truck infront of me and bounces back, air bag goes off . I'm hurt my foot not even a year ago. May 22, 2012. I was at my neighbor's house when her husband called, She was outside in her pasture fixing a fence. I went to take the cell phone out to her. I forgot to put on my shoes. As I was walking, I was about 5 feet from her and my older brother. And I fell to the ground. A Re-bar about the width of a pinky went through my left foot inbetween the toe by the pinky going 4 inches inside. I had to stay in the hospital for 8 days. Almost losing my foot. I have no feeling in my toe but at the top of my foot, just touching it causes me to feel pain. Is it possible for her Home Owner's Insurance to pay at least half or all my medical bills? I owe over $36,000. This also Happened in Oklahoma, and I moved to Missouri back in November (don't know if that would affect my chances). My mother decided that she didn't want my neighbor to pay for it. And I'm disagreeing.

Ok, So I have insurance through UAIC. I was not aware till the research i've done they are the biggest losers in the business. Here's my issue, my car was vandalized on november 12 of this year. I have full coverage insurance. Prior to insurance, we agreed to have photos taken by the local insurance so they can note any problem.. Car clear perfect which it was. No a scratch, ding or dent showroom conidition I would say at the time. I filed the claim the same day of the 12th of November. It took them 2weeks just to come estimate the car, estimate was 1500 and let me tell you. My smallest quote was 2900$ so immediately I was a little worried about it. Well I finally got a call back today on december 13th. Telling me the insurance estimator for them said the car had prior wear and tear. Which it was absolutely not! i treat my car great and have pictures to proof it. What can I do, and I see no point in full coverage with these guys! Insurance Fraud? Help!?

A couple days ago I was driving to a doctors appointment, I was rushing and very nervous. I got to a road that was closed where I had to back up. I looked behind me and saw no cars. Then I started talking to my mother who was in the car about if the road was closed or just partly blocked off. I looked in my mirrors and started to back up, somehow I must have missed the car that was very close behind me. I barely tapped the bumper, my mom didn't even realize it happened that's how slight the tap was. The woman immediately jumped out of her car and started screaming and cussing like a maniac. The police blocking the road even noticed and had to come over to control her. There was no damage to my car or hers, however she was driving a 92 buick and it was a piece of junk. I was worried she'd try to get something out of the whole thing so I took pictures of everything. This must have made her angry and she started trying to take pictures of my mother and I as well as bird poop on my car? Today I got a call from her insurance agency, saying she claimed injuries, a cracked windshield, and a messed up bumper. I am so angry! I know I did not do any damage, much less injure her! I'm a collage student and really can't afford my rates going up because of this. I called my insurance company and sent them pictures. They are trying to investgate. I had an accident a month or two ago. It was in a rental car. I found out today that the insurance company had disallowed some of the charges that the rental company tried to pass to them. Now the rental company is trying to pass those charges to me. They ammount to about $500, plus my deductible, of course. The charges are $100 for an administrative fee $200.89 loss of use fee $139.38 diminished value fee. Who should pay these charges? Should I fork this money over to the car rental company? Should the insurance company pay them? What strategy should I use in my conversations with them? My feeling is that I have insurance, it should pay everything which is an actual cost above and beyond the deductible. ie if I have to pay it, the insurance company should have to pay it. On the other hand, if they are somehow bogus charges, then the rental company can eat it, and that's fine. Thought?

one of our cars', 93 Toyota Tercel just got totalled out in a fender bender that was caused by another driver. since we only have collision insurance with AmFam on it, the other woman's company made the pay out to us (~$2K) and let us keep the car. we decided to fix the car up mechanically, and give it a bit of a face lift on the mangled front side fender, but didnt really put too much money into it. so the question is.... as we continue to drive the car, and G*d Forbid, anything similar should happen again, when we are not at fault and there's no bodily damage, just car damage, would we be able to get the other insurance company to pay for the car repairs? or will they say, well, you already had it totalled out once, we're not gotta give you $ to fix a car that not worth much... or how does this work? anyone have any experience with this? anyone here an insurance adjuster? thanks in advance

I work 2 part time jobs and neither offer health insurance, so in 2014 I will have to buy some. One comparable to the one I had when I worked a full time job would cost $600 a month but would cover prescriptions with a $20 copay for generics with a $1500 deductible and a $4500 out of pocket maximum. That is out of what I can afford. The one I can afford is only $219 a month but has a $7500 deductible which would have to be met for any benefits and there is a $12,500 out of pocket maximum. If I got very sick I would be wiped out with that one, so it seems that I am in a Catch 22. I don't make that much money ($8 and $10 for the 2 jobs where I work 24 and 18 hours a week respectively.) Now I just pay the doctor out of pocket and I paid $375 this year for office visits and $150 for medicine. That was affordable and now I am forced to pay a premium in addition to the same amounts I paid for the same service. This thing is making me nervous. Affordable to me is no insurance. Give me a cyanide pill if I get a terminal diagnosis because being in the hospital and wiped out financially is not a good quality of life.

Can California Civil Code 827 be used to enforce mandatory renters insurance?

Recently my landlord sent tenants a letter stating we have to buy renter's insurance, stating that California Civil Code 827 allows them to do this. Looking it up, I see 827 is about rent increased, not renter's insurance (and nothing about anything being mandatory). When I signed the lease with them, I was not required to pay for renter's insurance, but they claim that terms have changed and now I am obligated to pay this, and if I don't, may destroy my credit. All because of Civil Code 827. Can they actually do this? Or is this letter some kind of tactic to coerce me into signing this document and providing insurance? Thanks!
